Member States have different systems in place for the imposition of pecuniary sanctions, application of administrative measures and imposition of periodic penalty payments. In addition, certain administrative measures that supervisors are empowered to apply, such as the withdrawal or suspension of a licence, are dependent on the execution of those measures by other authorities. In order to cater for such a diverse range of situations, it is appropriate to allow flexibility as regards the means that supervisors have to impose pecuniary sanctions, apply administrative measures and impose periodic penalty payments. Regardless of the means chosen, it is incumbent on Member States and the authorities involved to ensure that the mechanisms implemented achieve the intended result of restoring compliance and impose effective, dissuasive and proportionate pecuniary sanctions.
