# Article 60 — Exercise of the powers referred to in Articles 61 to 63

The powers conferred on ESMA or any official of or other person authorised by ESMA by [Articles 61](/emir/articles/61.md) to 63 shall not be used to require the disclosure of information or documents which are subject to legal privilege.
