Firms authorised in accordance with them do not enjoy the freedom to provide services and the right of establishment in Member States other than the one where they are established. Where a Member State considers that the appropriate level of protection for its retail clients or retail clients who have requested to be treated as professional clients can be achieved by the establishment of a branch by the third-country firm it is appropriate to introduce a minimum common regulatory framework at Union level with respect to the requirements applicable to those branches and in light of the principle that third-country firms should not be treated in a more favourable way than Union firms.","marks":[],"text_hash":"173573db8623d6d0100d1cd0ea8572e9eaa1d43324ef1d7a5ae31ce036b3411c","revision":1,"blocks":[{"locator":"mifid2/recitals/rec/109/block/1","text_hash":"173573db8623d6d0100d1cd0ea8572e9eaa1d43324ef1d7a5ae31ce036b3411c","revision":1}]}}
