A natural or legal person, other than the [manufacturer](https://www.headlesslaw.com/definitions/cra/manufacturer), the [importer](https://www.headlesslaw.com/definitions/cra/importer) or the [distributor](https://www.headlesslaw.com/definitions/cra/distributor), that carries out a [substantial modification](https://www.headlesslaw.com/definitions/cra/substantial-modification) of a [product with digital elements](https://www.headlesslaw.com/definitions/cra/product-with-digital-elements) and makes that product available on the market, shall be considered to be a manufacturer for the purposes of this Regulation. 2.
