proceedings","text":"## <a id=\"art-5\"></a>Article 5 — Opening of proceedings\n\n1. <a id=\"art-5-p-1\"></a>The Commission may initiate proceedings in view of the possible adoption of decisions pursuant to Article 101(1) of Regulation (EU) 2024/1689 in respect of relevant conduct by providers of general-purpose AI models set out in that Article.\n\n2. <a id=\"art-5-p-2\"></a>Notwithstanding paragraph 1, the Commission may exercise its powers under Section 5 of Chapter IX of Regulation (EU) 2024/1689 before opening proceedings pursuant to that paragraph.\n\n3. <a id=\"art-5-p-3\"></a>Before opening proceedings pursuant to paragraph 1, the Commission may, by decision, order interim measures against a provider of general-purpose AI model on grounds of urgency due to a risk of serious damage to health, safety requirements, or other grounds relating to the public interest covered by Regulation (EU) 2024/1689, including preventing a general-purpose AI model from being made available on the market, based on a prima facie finding of an infringement of that
