periods for the enforcement of penalties","text":"## <a id=\"art-11\"></a>Article 11 — Limitations periods for the enforcement of penalties\n\n1. <a id=\"art-11-p-1\"></a>The power of the Commission to enforce decisions adopted pursuant to Article 101(1) of Regulation (EU) 2024/1689 shall be subject to a limitation period of five years.\n\n2. <a id=\"art-11-p-2\"></a>The time shall begin to run on the day on which the decision adopted pursuant to Article 101(1) of Regulation (EU) 2024/1689 becomes final.\n\n3. <a id=\"art-11-p-3\"></a>The period referred to in paragraph 1 shall be interrupted:\n\n    <a id=\"art-11-p-3-a\"></a>**(a)** by notification of a decision varying the original amount of the fine or periodic penalty payment or refusing an application for variation;\n\n    <a id=\"art-11-p-3-b\"></a>**(b)** by any action of the Commission or of a Member State, acting at the request of the Commission, designed to enforce payment of the fine or periodic penalty payment.\n\n4. <a id=\"art-11-p-4\"></a>Each interruption of the period referred to in paragraph 1 shall start time running afresh.\n\n5. <a id=\"art-11-p-5\"></a>The limitation period for the enforcement of penalties shall be suspended for as long as:\n\n    <a id=\"art-11-p-5-a\"></a>**(a)** time to pay is allowed; or\n\n    <a id=\"art-11-p-5-b\"></a>**(b)** enforcement of payment is suspended pursuant to a decision of the Court of Justice of the European Union or pursuant to a decision by a national court.\n\n**CHAPTER V — GENERAL AND FINAL
